بيان موقف منظمات المجتمع المدني اليمنية بشأن الوضع في اليمن ، وتأييد طلب إنشاء لجنة تحقيق دولية شاملة في اليمن .

تشهد الجمهورية اليمنية تدهورًا خطيرًا ومتصاعدًا في أوضاع حقوق الإنسان جراء نزاع مسلح طال أمده، ومع تصاعد الأزمة الحالية وتبادل الاتهامات الدولية بشأن المسؤولية عن الانتهاكات الحقوقية التي ارتُكبت خلال سنوات الحرب ، ولا سيما بين أطراف في دول التحالف العربي ، بات ملف انتهاكات حقوق الإنسان مهددًا بالتسييس والانتقائية المفرطة والسعي لتحويل معاناة الضحايا وحقوق الشعب اليمني إلى أداة توظيف في صراع سياسي وإقليمي ودولي جديد .
والواقع ان هذا الوضع قد تفاقم عقب طلب السعودية والحكومة اليمنية من دولة الإمارات العربية المتحدة الخروج من التحالف العربي ومن اليمن بتاريخ 2 يناير، وما أعقب خروجها من اتهامات متبادلة بينها وبين الحكومة اليمنية المعترف بها دوليًا والمدعومة من المملكة العربية السعودية، مقابل نفي إماراتي قاطع لتلك الادعاءات. ويعكس هذا التراشق الدولي للاتهامات المتبادلة خطورة ضياع الحقيقة والعدالة في خضم صراع سياسي دولي جديد ، بدلًا من إنصاف الضحايا.
وإزاء كل ذلك، تؤكد منظمات المجتمع المدني اليمنية أنها لا تقف مع اي طرف صراع ضد الاخر في الوضع الحالي ولا يمكنها ان تصدق اتهامات يسردها اي طرف صراع ضد الاخر في الوضع الحالي ،وتعتبر ان كل السرديات المطروحة من كل الاطراف مجرد مزاعم واتهامات تحتاج إلى فحصها وتحقيقها من قبل لجنة تحقيق دولية شاملة ومستقلة تكلفها الامم المتحدة للتحقيق مع كل الأطراف الدولية والمحلية المتصارعة في اليمن ، كما ان المنظمات المدنية اليمنية تعتبر ان الآليات اليمنية الحالية، وعلى رأسها اللجنة الوطنية الحكومية للتحقيق في ادعاءات انتهاكات حقوق الإنسان وماتقوم به اللجنة حاليا من اجراءات لامعنى لها ولاقيمة ، لانه سبق لذات اللجنة طوال السنوات الماضية انكار هذه الاتهامات وذلك الرفض موثق في تقاريرها السابقة ، ناهيكم عن ان اللجنة الوطنية والمنظمات المحلية التي تتحرك معها حاليا انما تتبع لطرف واحد من اطراف الصراع الحالي وتسوق لروايته ، وليس هذا فحسب ، بل ان هذه اللجنة الحكومية اساسا تفتقر حاليا إلى الولاية القانونية والاستقلال والقدرات اللازمة للتحقيق في الانتهاكات ذات الطابع الدولي أو الجرائم التي يُشتبه بتورط أطراف إقليمية ودولية فيها ، بما في ذلك جرائم الحرب والجرائم ضد الإنسانية، الأمر الذي يُكرّس الإفلات من العقاب ويُبقي الضحايا اليمنيين بلا إنصاف.
وانطلاقًا من مسؤوليتها الحقوقية والأخلاقية ، تدعو منظمات المجتمع المدني اليمنية الأمم المتحدة ومجلس حقوق الإنسان والمجتمع الدولي إلى التحرك العاجل لإنشاء لجنة تحقيق دولية شاملة، مستقلة ومحايدة، للتحقيق في جميع الانتهاكات المرتكبة في اليمن منذ بداية النزاع حتى الان دون استثناء، وربط نتائجها بمسارات المساءلة القضائية الدولية، تأكيدًا على أن السلام المستدام في اليمن والمنطقة لا يمكن أن يتحقق دون عدالة دولية شاملة ومستقلة ومحاسبة حقيقية وانصاف للضحايا وللشعب اليمني، وهو ما نسعى لتحقيقه بعيدا عن روايات اطراف الصراع الحالية في اليمن .

.Position Statement by Yemeni Civil Society Organizations on the Situation in Yemen and in Support of the Establishment of a Comprehensive International Commission of Inquiry.

The Republic of Yemen continues to experience a grave and escalating deterioration in human rights as a result of a protracted armed conflict. With the intensification of the current crisis and the recent exchange of international accusations regarding responsibility for human rights violations committed over years of war—particularly among parties within the Arab Coalition—the human rights file has become increasingly vulnerable to politicization, excessive selectivity, and instrumentalization. This trend risks turning the suffering of victims and the rights of the Yemeni people into tools within a new regional and international political conflict.
This situation further escalated following Saudi Arabia’s and the internationally recognized Yemeni government’s request for the United Arab Emirates to withdraw from the Arab Coalition and from Yemen on 2 January, and the subsequent exchange of serious accusations between the UAE and the Yemeni government, backed by the Kingdom of Saudi Arabia, alongside a categorical Emirati denial of those allegations. This international exchange of accusations underscores the serious risk that truth and justice will be lost amid a new international political confrontation, instead of prioritizing justice for victims.
In light of these developments, Yemeni civil society organizations affirm that they do not align themselves with any party to the conflict against another in the current situation, nor can they accept or endorse allegations presented by any party against another. They consider all narratives currently put forward by the various parties to be mere claims and accusations that require impartial examination and verification by a comprehensive, independent international commission of inquiry mandated by the United Nations to investigate all local and international parties involved in the conflict in Yemen.
The organizations further stress that the existing Yemeni mechanisms—chiefly the government-affiliated National Commission to Investigate Alleged Human Rights Violations—and the steps it is currently taking are devoid of meaning or value. This is due to the fact that the same commission has, throughout past years, denied similar allegations, a position documented in its previous reports. Moreover, the national commission and the local organizations currently acting alongside it are aligned with one party to the conflict and promote its narrative. Beyond that, the commission fundamentally lacks the legal mandate, independence, and institutional capacity required to investigate violations of an international character or crimes in which regional and international actors are suspected of involvement, including war crimes and crimes against humanity. This reality entrenches impunity and leaves Yemeni victims without justice.
Accordingly, and in fulfillment of their legal and moral responsibilities, Yemeni civil society organizations call upon the United Nations, the Human Rights Council, and the international community to take urgent action to establish a comprehensive, independent, and impartial international commission of inquiry to investigate all violations committed in Yemen since the outbreak of the conflict to the present, without exception. They further call for linking the findings of such an investigation to international judicial accountability mechanisms, affirming that sustainable peace in Yemen and the region cannot be achieved without comprehensive and independent international justice, genuine accountability, and full redress for victims and for the Yemeni people—away from the competing narratives of the current parties to the conflict.
