تُعرب رابطة معونه لحقوق الإنسان والهجرة عن بالغ قلقها إزاء التدهور الحاد والمتواصل للأوضاع الإنسانية والحقوقية في الجمهورية اليمنية، في ظل استمرار النزاع المسلح وتعدد أطرافه المحليين والاقليميين والدوليين، وما رافقه من نمط واسع ومنهجي من الانتهاكات الجسيمة للقانون الدولي الإنساني وقانون حقوق الإنسان، بما في ذلك جرائم الحرب، والجرائم ضد الإنسانية والحصار الاقتصادي ، وأعمال الإرهاب، وغيرها من الجرائم الدولية الأشد خطورة.

لقد شهد اليمن خلال سنوات النزاع موجات متلاحقة من الانتهاكات، شملت استهداف المدنيين والبنية التحتية المدنية، والاعتقالات التعسفية، والإخفاء القسري، والتعذيب، والتجنيد القسري للأطفال، والهجمات الإرهابية، والقيود التعسفية على المساعدات الإنسانية، في ظل غياب المساءلة واستمرار الإفلات من العقاب. كما أدى تعطّل آليات التحقيق الوطنية والدولية الفعّالة إلى تعميق معاناة الضحايا وتقويض الثقة في سبل العدالة.

وانطلاقًا من مسؤوليتنا الحقوقية والأخلاقية، تدعو رابطة معونه المجتمع الدولي، والدول الأعضاء في الأمم المتحدة، إلى التحرك العاجل من أجل:
1. تشكيل آليات تحقيق جنائية دولية شاملة، مستقلة ومحايدة، تتمتع بولاية واضحة لجمع الأدلة وحفظها وتحليلها، والتحقيق في جميع الانتهاكات والجرائم الدولية المرتكبة في اليمن دون استثناء أو انتقائية، وبما يضمن حماية الشهود والضحايا.
2. تعزيز مسارات المساءلة الدولية عبر الدفع الجاد نحو إحالة الملف اليمني بشكل كامل إلى المحكمة الجنائية الدولية، بما يتيح التحقيق والملاحقة القضائية للمسؤولين عن جرائم الارهاب والجرائم الدولية الأشد خطورة، أياً كانت صفتهم أو مواقعهم.
3. ضمان حق الضحايا في الانتصاف الفعّال، بما يشمل جبر الضرر والتعويض وإعادة التأهيل وضمانات عدم التكرار، وفق المعايير الدولية ذات الصلة.
4. دعم العدالة وسيادة القانون بوصفهما ركيزة أساسية لأي مسار سلام مستدام، والتأكيد على أن السلام الحقيقي لا يتحقق دون مساءلة ومحاسبة.

وتؤكد رابطة معونه أن الإفلات من العقاب يشكل تهديدًا مباشرًا للسلم والأمن الدوليين، وأن التقاعس عن اتخاذ إجراءات حاسمة سيُفضي إلى مزيد من الجرائم ومعاناة المدنيين. وعليه، فإننا نحثّ المجتمع الدولي على الاضطلاع بمسؤولياته القانونية والأخلاقية، واتخاذ خطوات ملموسة وفورية لضمان العدالة، والمساءلة، وكرامة الضحايا في اليمن.

Association Ma’onah for Human Rights and Immigration (AMHRI) Renews Its Call for a Comprehensive International Investigative Process into All Violations, War Crimes, and Acts of Terrorism Committed Against Civilians in Yemen .

The Association Ma’onah for Human Rights and Immigration (AMHRI) expresses its profound concern over the severe and ongoing deterioration of the humanitarian and human rights situation in the Republic of Yemen, amid the continuation of the armed conflict and the multiplicity of its local, regional, and international actors. This context has been accompanied by a widespread and systematic pattern of grave violations of international humanitarian law and international human rights law, including war crimes, crimes against humanity, economic blockade, acts of terrorism, and other most serious international crimes.

Throughout the years of conflict, Yemen has witnessed successive waves of violations, including attacks against civilians and civilian infrastructure, arbitrary detention, enforced disappearance, torture, the forced recruitment of children, terrorist attacks, and arbitrary restrictions on humanitarian assistance. These violations have occurred in a climate marked by the absence of accountability and the persistence of impunity. The paralysis of effective national and international investigative mechanisms has further deepened victims’ suffering and undermined confidence in avenues for justice.

In fulfillment of its human rights and moral responsibilities, AMHRI calls upon the international community and United Nations Member States to take urgent action to:
1. Establish comprehensive, independent, and impartial international criminal investigative mechanisms with a clear mandate to collect, preserve, and analyze evidence, and to investigate all violations and international crimes committed in Yemen without exception or selectivity, while ensuring the protection of victims and witnesses.
2. Strengthen international accountability pathways by seriously pursuing the full referral of the Yemeni situation to the International Criminal Court, enabling investigation and prosecution of those responsible for acts of terrorism and the most serious international crimes, regardless of their status or position.
3. Guarantee victims’ right to effective remedy, including reparations, compensation, rehabilitation, and guarantees of non-repetition, in accordance with relevant international standards.
4. Support justice and the rule of law as fundamental pillars of any sustainable peace process, and affirm that genuine peace cannot be achieved without accountability.

AMHRI emphasizes that impunity constitutes a direct threat to international peace and security, and that failure to take decisive action will result in further crimes and increased suffering of civilians. Accordingly, we urge the international community to uphold its legal and moral responsibilities and to take concrete and immediate steps to ensure justice, accountability, and the dignity of victims in Yemen.
